In Florida, when someone is injured in an automobile accident, the insurance company must pay up to $10,000 in benefits - regardless of who is at fault. They must pay 80% of medical fees and 60% of lost wages (plus all expenses for essential services the injured person was unable to perform). If an insurance company denies or reduces payments for these expenses a PIP claim can be filed.

Once our office issues a PIP demand, a response is expected within 30 days of the insurer’s receipt. If no response is received by this initial deadline, we immediately file litigation against the company - which leads to an unpredictable time frame. The standard statute of limitations for contract claims is 5 years. For PIP purposes, it is 5 years from the date that the claim is past-due; not 5 years from the date of loss.
